THAT the Minor Variance Application MV2025-03, for lands located at 8 North Hastings Avenue, Marmora and Lake, legally described as Part Lot 4 of Plan 264, Part 1 of RP 21R-13898, Municipality of Marmora and Lake, to permit the construction of a garage that will have deficient interior yard setbacks and increased lot coverage, BE APPROVED; AND THAT the Committee of Adjustment is satisfied that the application meets the four tests of minor variance. The variance is desirable, as it is an appropriate use of the land and is appropriate for a residential neighbourhood. The location is also logical as it is located to be accessible from the existing driveway. The impact of the variance can be considered minor in nature, as the difference between the permitted and proposed interior yard setbacks and permitted lot coverage is minimal. The lot is designated Urban Residential in the Urban Communities Secondary Plan, and the proposed variance meets the intent of the Official Plan, as the proposed garage is consistent with the residential use of the property. The intent of the maximum lot coverage for Page 3 of 5 Committee of Adjustment June 3, 2025 accessory buildings in the Zoning Bylaw may be interpreted to ensure that accessory structures are not too large to be considered ancillary to the main building. There will only be a small increase in size to the permitted lot coverage. The intent of the interior yard setback is a sufficient setback between neighbouring properties for privac

THAT the Minor Variance Application MV2025-04, for lands located at 112 Fish Hook Lane, Marmora and Lake, legally described as PLAN M63 LOT 74, Municipality of Marmora and Lake, to permit the construction of an accessory building located in front of the dwelling, with an interior yard setback of 2.7 metres, and a gross floor area of 66.9 square metres, BE APPROVED; AND THAT the Committee of Adjustment is satisfied that the application meets the four tests of minor variance. The variance is desirable, as the development of a garage will allow for the orderly storage of the owner’s property, such as vehicles and boats. The impact of the variance can be considered minor, as the difference between the permitted and proposed interior yard setback is minimal, the location of the proposed garage in front will be setback 25 metres from Fish Hook Lane, which is a considerable distance, and there are several surrounding lots with accessory buildings that are relatively the same size (or larger), so the impact of the difference between the maximum permitted size and proposed size is minimal. The application is within the Rural/Waterfront designation of the Hastings County Official Plan, as the proposed garage is consistent with the residential use of the property. Likewise, the intent of the Zoning Bylaw preventing the garage from being located in front of the dwelling may be interpreted as to prevent the garage from appearing incongruent with the dwelling. In this case, the garage will
